Terms of Service for Barrel Burner Application

1. Acceptance of Terms

By downloading, installing, or using the Barrel Burner Tracking App ("the App"), you agree to be bound by this User Agreement ("Agreement"). If you do not agree, discontinue use immediately.

2. Eligibility

You must be at least 18 years old and legally permitted to own and track firearms in your jurisdiction. By using the App, you confirm that you meet these requirements.

3. Purpose of the App

The App is designed for lawful tracking and monitoring of firearm barrel usage. It must not be used for any illegal activities, including unauthorized firearm modifications, tracking stolen firearms, or any activity that violates local, state, or federal laws.

4. User Responsibilities

• You agree to comply with all applicable firearm laws and regulations.

• You are responsible for the accuracy of the data you input.

• Misuse of the App for illegal purposes may result in account termination and legal consequences.

 

5. Data Collection & Privacy

• The App collects firearm-related data solely for tracking purposes.

• We do not share your data without consent, unless required by law.

• Data is securely encrypted, but no system is immune to security risks.

• You may request data deletion at any time by contacting: support@barrelburnerapp.com

 

6. Limitation of Liability

• The App is provided "as is" with no warranties of any kind.

• We are not liable for loss, damage, or legal issues resulting from improper use.

• Firearm safety and maintenance are your responsibility.

• The App does not replace professional advice or compliance with firearm laws.

 

7. Modifications to Agreement

We may update this Agreement at any time. Continued use after changes constitutes your acceptance.

8. Termination

We may suspend or terminate your access to the App at any time for violating this Agreement or engaging in illegal or harmful behavior.

9. Governing Law, Venue, and International Arbitration

This Agreement is governed by the laws of Laramie County, Wyoming, USA.

Disputes will be resolved through final and binding arbitration:

• International users: ICC Rules

• U.S. users: AAA Commercial Rules

• Arbitration will be held in Laramie County, Wyoming, in English.

Either party may seek injunctive relief in Laramie County courts. You waive any right to a jury trial or class action.

10. Firebase Services

The App uses Firebase (by Google) for storage, login, analytics, and crash reporting. By using the App, you agree to Firebase Terms and Privacy Policy.

12. Apple Device and App Store Terms

a. Acknowledgement: This Agreement is between you and Barrel Burner LLC, not Apple. Apple is not responsible for the App.
b. Scope of License: You are granted a non-transferable license to use the App on your Apple-branded devices per the Apple Media Services Terms.
c. Maintenance and Support: Barrel Burner LLC provides all support; Apple has no obligation to do so.
d. Warranty: If the App fails to meet warranty, notify Apple for a refund. Apple is not responsible beyond that.
e. Product Claims: Barrel Burner LLC is responsible for all claims, including regulatory compliance and privacy.
f. IP Claims: Barrel Burner LLC handles all third-party IP claims.
g. Legal Compliance: You confirm you are not in an embargoed country or on any U.S. restricted parties list.

i. Third-Party Beneficiary: You and Barrel Burner LLC acknowledge Apple is a third-party beneficiary and can enforce this Agreement.
